What is Mediation?
Mediation is a process that can be used by people to negotiate an agreement to resolve a dispute. It can be voluntary or court-ordered. The process is facilitated by an independent third party known as a mediator.
Mediators can help people who are in conflict to discuss the issues, understand each other’s point of view and explore possible options for resolving the problem.
Mediation is a cost-effective tool for parties to try and reach an agreement without the need to resort to litigation.
What is Family Dispute Resolution (FDR)?
Family Dispute Resolution is a special type of mediation that is conducted by a Family Dispute Resolution Practitioner (“FDRP”). An FDRP will help people affected by separation to discuss and sort out their family disputes in relation to parenting and/or property matters.
Before you can commence proceedings in the Federal Circuit and Family Court of Australia for parenting matters it is compulsory (unless you fit within one of the exceptions) to participate in Family Dispute Resolution.
In the event that you are unable to reach an agreement you will be issued with a section 60I Certificate which then enables you to commence Court proceedings.
